How not to raise legal ethics issues as to a candidate - Le?gal In?sur ...

Starting with my post Elizabeth Warren?s law license problem?last Monday and continuing through the week, I have laid out the facts and documents regarding Elizabeth Warren?s practice of law from her Cambridge office over the course of a decade.

I also have noted that Warren refuses to disclose the full extent of her practice, so what we know is limited to what we have been able to dig out of public records.? ?I wish we had more from the Warren campaign, but any additional facts almost certainly will make the situation worse for Warren as such facts will reveal more cases and more legal practice.

A number of critics have disagreed with my legal conclusions from these facts, although some of them are coming around to recognize the seriousness of Warren?s predicament.

But not a single critic has been able to show that any of the facts I?presented are incorrect.? Nor could they, because?I presented the documents.

Contrast my fact-based, document-driven presentation with?the way in which Georgetown Law Professor Adam Levitin raised ethical issues with regard to Scott Brown?s practice of law at the Credit Slips blog, Did Scott Brown Facilitate Predatory Loans?

In that blog post, which has been linked and cited as authority by Huffington Post, Levitin suggested that Brown may have ethical problems, without presenting any?evidence.

Instead, Levitin just threw out a bunch of questions wondering whether Brown facilitated predatory lending because one of the mortgage companies for which he did title work in local house closings owned a separate company which was accused of predatory lending.

That?s right, the only facts cited by Levitin were that Brown did title?work for a company which itself did nothing wrong, but which owned a separate entity which allegedly did something wrong.? No facts were presented as to what Brown himself allegedly did wrong.

From that sparse and tangential (at best) relationship, Levitin wrote, in part (emphasis mine):

But at the very least, Brown?s association raises a host of questions. Who were those ?mortgage companies? that he worked for?? It?s nice that Brown named a bunch of local banks, but I wonder what lies under the ?mortgage company? label?? What did Scott Brown understand about the mortgage market he was facilitating? Did he recognize that there was a bubble?? (He was a town property assessor at one point, so one would think he?d notice this sort of thing.) If not, what does that say?? And if so, what does that say? How many predatory loans did Scott Brown facilitate?? How many of the loans where he handled the closing resulted in foreclosure?? What would he say to those families that lost their homes to predatory loans?

I suspect that Brown?s reply to these questions would be ?Aw shucks, I?m just a guy with a pickup truck with 238,000 miles on it who was helping people out by doing the paperwork on their real estate closings.?? That?s not good enough. Either Brown was so inept that he didn?t see that the loans he was closing were becoming untenable or Brown saw the problem and didn?t do anything. As long as the music?s playing, the guy?s gotta earn a living, right?

I have highlighted the sentence in question because it suggests that loans Brown closed became ?untenable? and that there were problems ?Brown saw ? and didn?t do anything? about.? Where is the evidence of that?? Where is the public record of loans Brown closed which were predatory?? Where is the evidence that such loans resulted in an inordinate number of foreclosures?

Levitin also doesn?t present any law as to how, assuming some of the loans Brown closed were ?predatory,? Brown violated any ethical obligations by acting as the closing attorney.?? Indeed, Levitin conceded there were no legal ethics issues:

Obviously as a legal matter, the attorney handling a real estate closing has no duty to shield people from making a bad business decision (particularly if he?s representing the bank).

There is no evidence and no law to suggest that Brown had ethical issues.? Instead,?Levitin just threw out hypothetical questions which, by the way in which they?were asked, presumed that Brown did something wrong.

From that, Levitin concluded:

At the very least, it looks like Scott Brown was riding the mortgage bubble, serving as a cog in the machine.

It is irresponsible law professor blog posts like Levitin?s which make it harder for serious issues, such as Warren?s law license problem, to be taken seriously.

When there are law professors who just throw ethical accusations?with reckless abandon, it besmirches those of us who do take the time to present the evidence and the law, and to raise issues the mainstream media doesn?t understand or willfully ignores.

Update:??This is interesting:

?She expects a lot,? said Adam Levitin, a professor at Georgetown Law School who was a student of Warren?s at Harvard between 2002 and 2005. But, he said, Warren also gives a lot.

?She prepares assiduously and takes the teaching very seriously as part of her job. No one doesn?t think they?ve gotten their money?s worth out of the class,? Levitin said.

I?m sure if I dug deeper, I?d find more connection. But I?m too busy digging for facts as to Warren?s practice of law.

Yemen's president acknowledges approving U.S. drone strikes

Yemen's president said Saturday that he personally approves every U.S. drone strike in his country and described the remotely piloted aircraft as a technical marvel that has helped reverse al-Qaeda's gains.

President Abed Rabbo Mansour Hadi also provided new details about the monitoring of counterterrorism missions from a joint operations center in Yemen that he said is staffed by military and intelligence personnel from the United States, Saudi Arabia and Oman.

Hadi's comments mark the first time he has publicly acknowledged his direct role in a campaign of strikes by U.S. drones and conventional aircraft targeting an al-Qaeda franchise that is seen as the most potent terrorist threat to the United States.

"Every operation, before taking place, they take permission from the president," Hadi said. Praising the accuracy of the remotely operated aircraft, he added, "The drone technologically is more advanced than the human brain."

The U.S. Joint Special Operations Command and the CIA have carried out 33 airstrikes in Yemen this year, compared with 10 in 2011, according to the Long War Journal website, which tracks drone attacks.

Choose Your Own ?Ed-venture? ? Harrisburg Academy Blog

They say it ?takes a village? to raise a child and this was my driving force when researching childcare options for my newborn baby last spring.? And the choices for childcare, I soon discovered, were abundant!? My husband and I talked to countless colleagues for testimonials about their own childcare experiences.? We called several more providers for phone interviews and for the ones that interested us most, we scheduled in-person site visits.? We looked at many things in making our evaluation ? size, safety, cost, qualifications of employees, philosophies on early childhood education, and daily programming.? This was an enormous decision for our family that we did not take lightly.

I know I am not alone in my daycare search due diligence.? And on the other end of the spectrum, it seems as though families put comparable consideration into college choice.? Why is it, then, that so few families in the greater Harrisburg area seem to put the same thoughtfulness into their children?s formal ?K through 12? education?? I can only speak based on my own interactions with friends, family, and neighbors, but am surprised that these smart, caring, engaged parents ? the same ones who spent hours making a daycare decision for their own little ones? ? don?t consider education beyond the local public school district.

What is my purpose in telling you this?? To remind our readers that each and every family in the Harrisburg region, Central Pennsylvania, the Commonwealth, and the United States as a whole ? has a choice in their child?s education.? Take the time to understand your options and their access and affordability.? Consider non-public options through state and local organizations, such as the Pennsylvania Association of Independent Schools, the Association of Delaware Valley Independent Schools, and broader organizations, like the National Association of Independent Schools.? Looking to compare public, public charter, religious, and independent schools??? Try something like GreatSchools as a starting point.

Above all, take the time to figure out the skills, interests, and passions of your child, and explore schools that excel in these areas.? Take the time to visit schools and learn about their communities, their traditions, and the character traits and learning outcomes they seek to instill in their students.? I guarantee you will come away from your search empowered with the possibilities of choice and with a clearer idea of the fantastic education options our region has to offer.

(AP) ? Arnold Schwarzenegger is confirming that he had a "hot affair" with actress Brigitte Nielsen at a time he and Maria Shriver were dating and already living together.

Schwarzenegger and Nielsen co-starred in the 1985 film "Red Sonja." Nielsen write in a memoir published last year that she and Schwarzenegger had an "outrageous affair" while making the movie and that she did know until later that he was involved with Shriver.

In his memoir "Total Recall," coming out Monday, Schwarzenegger writes that he and Nielsen did indeed have a "hot affair," but he knew it wouldn't last. In fact, their "fling" only made him realize that he wanted to marry Shriver.

Nielsen would soon marry Schwarzenegger's fellow action star, Sylvester Stallone.

A Crash Course in Landing Page Conversion | Small Business ...

Yesterday you learned what makes a good landing page and the 9 concepts below can be used as a checklist to keep you on track the next time you run a marketing campaign.

1. Where landing pages sit in the funnel

To understand the role of a landing page it helps to show visually how they fit into your marketing flow, from the traffic source, through your different test variants, and finally, the confirmation page.

2. Message match: Ad to Headline

This should be your first concern. Read your ad phrasing and then read the headline on your landing page to see how closely they correlate. One of the biggest reasons for a high bounce rate (and a poor PPC quality score for PPC) is that people lose the information scent when they arrive at your page, thinking they are in the wrong place.

Next stop? The back button. Then your competition.

3. A single CTA

Having a single call to action gives people only one thing to do and stops them wandering down the wrong path. Drill this into your head: only give them one thing to do and they will be more likely to do it.

4. Social sharing

There are 2 ways to add social sharing to your page. You can add them to your main page to show social proof or add them to your confirmation page (covered in part 9).

Don?t forget that a low count shows ?negative social proof? so if you want to use them, try using paywithatweet.com to get your ebook instead of a form. This boosts tweet counts in the background. Then show the widgets when the count is high enough and switch back to a form.

5. Use video to increase conversions

Studies have shown that using videos improve conversions. But why?

  • Higher engagement: Videos increase the time on page, giving your brand message longer to sink in
  • Feature yourself or company employees: Raise the trust factor by showing you?re real
  • People are lazy: Many prefer to watch rather than read

6. Trust factors

Some things that can help instill a sense of trust in your visitors are:

  • Number of participants: My personal favorite is for webinars or events. If you show a running count of how many people are attending it can really sell people on the value of the event.
  • Testimonials: They can be video, but written ones also work well, especially when associated with a brand that your visitors know
  • Client logos/endorsements: If you have recognizable clients include their logo.
  • Media mentions: Show the logos of big sites where you?ve been featured. Often achieved via a PR push around a product launch.

7. Visual design

Professional page design is also important for establishing trust ? but bad designs convert too (usually for cheesy pages selling miracle weight loss pills). So what can you do to improve your conversions using design?

There are a variety of techniques including directional cues like arrows, or people looking at your CTA, contrast, whitespace and color etc.. Read Designing for Conversion ? 8 Visual Design Techniques to Focus Attention on Your Landing Pages for a detailed exploration of this.

8. A/B Testing & Optimization

Your page is awesome, right? How do you know? You just made an assumption because you spent a boatload of time designing it and you are feeling proud of your masterpiece. The thing is, EVERY page can be better, and this is where testing and optimization come in.

How do you optimize your pages? Most people just throw out some ideas (often untrained people) and try a quick test based on a headline or button color change? but most tests fail.

A good process goes something like this:

  1. Gather user feedback on your page using tools like Olark (live chat) and Qualaroo (simple surveys). You?ll be surprised to learn where people are hitting barriers in your conversion funnel.
  1. Brainstorm ideas with a diverse collection of team members: Include customer support, designers, copywriters and information architects.
  1. Develop a hypothesis: Now that you have feedback and some ideas for a test page you need to create a hypothesis for why you think it will succeed and build your page with this in mind. Try writing it like this:

?Our Test Hypothesis: Will allowing visitors to download our PDF by providing their email address perform better than receiving it in exchange for a tweet? Considering that not everyone has a Twitter account, or is willing to share such information with their followers.?

It?ll you build a test page with a strong sense of purpose.

  1. Run the test: Finally, you need to set up a test with your new page against the original (control) page. Make sure you leave it running for at least a week to cover daily variations in behaviour and don?t stop the test until it?s had enough traffic to achieve statistical significance.
  1. Choose a winner: This is easy. Whichever performs best should be promoted to be your new champion page and the loser discarded.
  1. Try, try again: Remember that test will often not give you the results you were hoping for, but don?t give up if your first few attempts don?t pan out. Learn from them and keep trying.

9. Post-conversion strategies

We?re at the end of the funnel, and the most under utilized conversion opportunity space you have at your disposal. Your confirmation pages are prime real estate to engage with your new lead/customer, after all they have just signalled positive intent by converting.

Things you can add to your confirmation page:

  • Webinar follow up: Remind people that they will receive full videos and slides of the webinar even if they weren?t able to attend.
  • Social sharing: Ask people to share your page with their colleagues.
  • Follow you: on the social networks they hang out on the most
  • Freebies: If you were doing lead gen to give away an ebook or whitepaper, give them an extra one free as a thank you.
  • Ask them to subscribe to your newsletter: This is a great way to keep people in your sphere of influence for further re-marketing in the future.
  • The Amazon model: Use ?People who liked this also liked? ? to drive extra sales.

Student debt stretches to record 1 in 5 households

WASHINGTON (AP) ? With college enrollment growing, student debt has stretched to a record number of U.S. households ? nearly 1 in 5 ? with the biggest burdens falling on the young and poor.

The analysis by the Pew Research Center found that 22.4 million households, or 19 percent, had college debt in 2010. That is double the share in 1989, and up from 15 percent in 2007, just prior to the recession ? representing the biggest three-year increase in student debt in more than two decades.

The increase was driven by higher tuition costs as well as rising college enrollment during the economic downturn. The biggest jumps occurred in households at the two extremes of the income distribution. More well-off families are digging deeper into their pockets to pay for costly private colleges, while lower-income people in search of higher-wage jobs are enrolling in community colleges, public universities and other schools as a way to boost their resumes.

Because of the sluggish economy, fewer college students than before are able to settle into full-time careers immediately upon graduation, contributing to a jump in debt among lower-income households as the young adults take on part-time jobs or attend graduate school, according to Pew.

As a share of household income, the debt burden was the greatest for the poorest 20 percent of households, or those making less than $21,044. In all, 40 percent of U.S. households headed by someone younger than age 35 owed college debt, the highest share of any age group.

"Comparing the debt to their economic resources, the lowest-income fifth of households are the ones experiencing the greatest stresses," said Richard Fry, a senior economist at Pew who analyzed the numbers.

Noting that college enrollment has continued to climb since 2010, Fry added: "Until college enrollment peaks, I would not expect the amount of outstanding student debt to level off."

The study released Wednesday is based on the Survey of Consumer Finances, conducted every three years and sponsored by the Federal Reserve. The numbers are as of 2010, the latest available for that survey. Separate Fed data have pointed to subsequent increases in student loans since 2010 that totaled $914 billion in the April-June quarter, but don't provide demographic breakdowns on who shoulders the biggest burdens.

Both President Barack Obama and his Republican challenger in this year's election, Mitt Romney, have been seeking to court young voters with differing visions on how to address rising tuition and growing college debt. Obama wants to make tax credits for college expenses permanent and expand Pell grants for lower-earning families. Romney says that making government the direct source of federal student loans has not worked and simply drives tuition higher. He stresses the need to curb college costs.

The Pew report found that the richest 20 percent of households, or those with annual income of $97,586 or higher, owed the biggest share of outstanding student debt ? 31 percent, up from 28 percent in 2007. The poorest 20 percent of households also saw their debt grow, to 13 percent from 11 percent.

The richest households saw significant increases in per-household debt. For those with annual income of $97,586 to $146,791, college debt rose from $25,921 in 2007 to $31,989. For the richest 10 percent, making at least $146,792, college debt increased from $36,033 to $44,810.

Across all households, the average outstanding college debt increased from $23,349 to $26,682. For the poorest 20 percent of households, the average debt rose from $19,018 to $20,640.

In recent years, Americans have cut back on several other types of borrowing such as credit card use, with average household indebtedness falling from $105,297 in 2007 to $100,720 in 2010. Broken down by income levels, however, average total indebtedness for the bottom 20 percent of households by income actually rose from $17,579 in 2007 to $26,779; for the higher income groups, average indebtedness either was unchanged or declined.

Skip the cake? Neural processes at work during self-regulation identified

ScienceDaily (Sep. 26, 2012) ? Almost everyone knows the feeling: you see a delicious piece of chocolate cake on the table, but as you grab your fork, you think twice. The cake is too fattening and unhealthy, you tell yourself. Maybe you should skip dessert.

But the cake still beckons.

In order to make the healthy choice, we often have to engage in this kind of internal struggle. Now, scientists at the California Institute of Technology (Caltech) have identified the neural processes at work during such self-regulation -- and what determines whether you eat the cake.

"We seem to have independent systems capable of guiding our decisions, and in situations like this one, these systems may compete for control of what we do," says Cendri Hutcherson, a Caltech postdoctoral scholar who is the lead author on a new paper about these competing brain systems, which will be published in the September 26 issue of The Journal of Neuroscience.

"In many cases, these systems guide behavior in the same direction, so there's no conflict between them," she adds. "But in other cases, like the all-too-common inner fight to resist the temptation of eating the chocolate cake, they can guide behavior toward different outcomes. Furthermore, the outcome of the decision seems to depend on which of the two systems takes control of behavior."

A large body of evidence shows that people make decisions by assigning different values to the various options, says Antonio Rangel, a professor of economics and neuroscience and the senior author of the paper. To make their decisions, people select the choice with the highest value. "An important and controversial open question -- which this study was designed to address -- is whether there is a single value signal in the brain, or if there are instead multiple value signals with different properties that compete for the control of behavior."

According to the single-value hypothesis, Rangel explains, the ability to say no to the chocolate cake depends on just one system that compares values like healthiness and taste. But the multiple-value hypothesis suggests that there are different systems that process different values. The ability to turn down the cake therefore depends on whether the brain can activate the appropriate system -- the one that evaluates healthiness. If you do not want the cake, it means you place a higher value on health than on taste and your brain acts accordingly.

In the study, the researchers asked 26 volunteers to refrain from eating for four hours prior to being tested. During the experiment, a functional magnetic resonance imaging (fMRI) machine was used to measure the brain activity of the hungry participants while they decided how much they were willing to pay for different snacks, which were shown on a computer screen. The items, including foods like chips and vegetables, varied in taste and healthiness. The subjects were explicitly asked to make their choices in one of three conditions: while attempting to suppress their desire to eat the food, while attempting to increase their desire to eat the food, or while acting normally. The volunteers could do whatever they wanted to control themselves -- for example, focusing on the taste (say, to increase their desire to eat something delicious but unhealthy) or the healthiness of the item (to reduce that urge).

After a four-second period, the participants placed real bids for the right to buy the items that reflected the value they placed on the food.

The researchers found that activity in two different brain areas correlated with how much the participants said they wanted an item, as indicated by their bids. The two regions were the dorsolateral prefrontal cortex (dlPFC), which sits behind the temples, and the ventromedial prefrontal cortex (vmPFC), which is in the middle of the forehead just above the eyes.

Significantly, the two areas played very different roles in the self-regulation process. When volunteers told themselves not to want the food, the dlPFC seemed to take control; there was a stronger correlation between the signals in this area and behavior, while the signals in the vmPFC appeared to have no influence on behavior. When the volunteers encouraged themselves to want the food, however, the role of each brain region flipped. The vmPFC took control while the signals in the dlPFC appeared to have no effect.

The researchers also found that the brain's ability to switch control between these two areas was not instantaneous. It took a couple of seconds before the brain was able to fully ignore the conflicting region. For example, when a volunteer tried to suppress a craving, the vmPFC initially appeared to drive behavior. Only after a couple of seconds -- while the participant tried to rein in his or her appetite -- did the correlation between bids and vmPFC activity disappear and the dlPFC seem to take over.

"This research suggests a reason why it feels so difficult to control your behavior," Hutcherson says. "You've got these really fast signals that say, go for the tempting food. But only after you start to go for it are you able to catch yourself and say, no, I don't want this."

Previous work in Rangel's lab showed that when dieters made similar food choices, their decisions were controlled only by the vmPFC. The researchers speculate that because dieters are more accustomed to self-control, their brains do not show the neural struggle seen in the new study. If that is the case, then it may be possible that people can improve their self-control with more practice.

In addition to Hutcherson and Rangel, the other authors on the Journal of Neuroscience paper are Hilke Plassmann from the ?cole Normale Sup?rieure in France and James Gross of Stanford. The title of the paper is "Cognitive regulation during decision making shifts behavioral control between ventromedial and dorsolateral prefrontal value systems." This research was funded by grants from the National Science Foundation, the National Institutes of Health, and the Gordon and Betty Moore Foundation.

Jaguar bosses Ratan Tata and Ralph Speth have played down mounting speculation that the new Jaguar F-type will race next year, but have conceded that it is possible.

Reports by leading motorsport website Autosport.com suggested Jaguar is already committed to a GT3 race programme, most likely in late 2013 or 2014, with the final sign-off with a race preparation firm imminent. The deal is reported to be between the Williams F1 team, which is working with Jaguar on powertrain technology already, or experienced sports and touring car preparation.

However, at the launch of the Jaguar F-Type road car at the Paris motor show Speth said: ?There is a lot of speculation, but no decisions. This is a car we can do a lot of things with, and theoretically GT3 racing is one of them. There are no deadlines for a decision, and no dates to make plans ? first, we must launch the road car.?

Tata added: ?The F-Type is a sports car, not a racing car. It has not been built as an introduction to the racetrack, but as a sports car for the road that demonstrates our heritage and abilities.?

Presidential campaign is nice, and then again not

NEW YORK (AP) ? In a split-screen race for the presidency, Republican Mitt Romney and President Barack Obama were on their best campaign behavior in public Tuesday, all the while slashing away at each other in paid television ads.

In separate appearances in New York, they swapped criticism on foreign policy. But they did it politely, without mentioning each other by name.

Romney found fault with Obama's approach to education, but did so after paying a public compliment to Arne Duncan, who has the administration's Cabinet portfolio for the subject.

There was an outbreak of self-deprecating humor from Romney, as well, as he received a glowing introduction from former President Bill Clinton before speaking to the annual Clinton Global Initiative.

"If there's one thing we've learned this election season, it's that a few words from Bill Clinton can do any man a lot of good," joked the Republican candidate for the White House, referring to the former' president's strong speech on Obama's behalf at the Democratic National Convention earlier this month.

"All I got to do now is wait a few days for that bounce to happen," Romney quipped.

Joking or not, it was as close as the Republican challenger has come to publicly acknowledging recent polls showing Obama moving ahead in several battleground states and gaining ground in national surveys.

Cut to the television ads, and the political reality both campaigns are trying to create for voters in battleground states.

Of the five commercials the Obama campaign says it is airing most frequently, one accuses Romney and running mate Paul Ryan of backing a plan for Medicare that would raise out-of-pocket costs for seniors. Another says the Republican challenger favors tax cuts for millionaires that could be paid for by reducing existing tax breaks for education expenses.

A third says Obama, not Romney, has pushed back against China's unfair trade policies. A fourth asserts that part of Romney's personal fortune is invested in China and says he's never stood up to the country. "All he's done is send them our jobs," it says.

The Romney campaign listed six ads currently airing, four of which criticize Obama.

"Dear Daughter. Welcome to America," says the announcer in a commercial that shows a young baby. "Your share of Obama's debt is over $50,000."

Two spots feature coal miners accusing the administration of pursuing policies that go after their industry. "Obama said he was going to bankrupt any new power plants that opened up ... He's keeping his promise," says a miner shown in one. "I've got two young grandsons. I'm scared for their futures, let alone mine."

A fourth accuses Obama of failing to "stand up to China" and asserts, "His policies cost us 2 million jobs."

In the world not made up of television commercials, one report released during the day showed consumer confidence climbing to the highest level since February. A second report said home prices increased in July as sales rose and foreclosures fell.

Taken together, that amounted to encouraging news for the president, given that the slow-growing economy and 8.1 percent national unemployment are the public's top issues in the race for the White House.

Whatever the economic news itself, voters increasingly say the country is heading in the right direction. In an Associated Press-GfK poll taken at mid-month, 48 percent of registered voters said they expect the economy to improve in the next 12 months, compared to only 41 percent who said so in a survey in August.

Additionally, 41 percent of registered voters said in this month's poll that the nation is heading in the right direction, up from 34 percent saying the same in August.

Obama's handling of the economy, still tepid, is better than it has been. The latest AP-GfK poll finds 48 percent of registered voters approve of the president's handling of the economy, while 49 percent disapprove. In June, 56 percent disapproved and 43 percent approved.

Romney spoke first during the day, speaking to Clinton's organization.

He said the death of U.S. Ambassador Chris Stevens in Libya two weeks ago was caused by a terrorist attack, something Obama has refrained from saying.

"Many Americans are troubled by the developments in the Middle East," Romney said. "Syria has witnessed the killings of tens of thousands of people. The president of Egypt is a member of the Muslim Brotherhood. ... And Iran is moving toward nuclear weapons capability.

"We feel that we are at the mercy of events, rather than shaping events," he added.

Although Romney did not overtly criticize Obama's foreign policy in the speech, as he had on Monday, his words took on a sharper edge when he suggested to CNN during an interview that the White House had misled the American people by not characterizing the violence in Libya as a terrorist attack.

"The White House's failure to acknowledge that the assassination of our ambassador was a terrorist attack, a terrorist event, suggests that they are trying to paper over the seriousness of what's happening in the Middle East," Romney said.

In his New York speech, Romney said that if he is elected, he will create "prosperity pacts" in the Middle East, private-public partnerships designed to remove barriers to free markets around the region. He said developing countries would receive U.S. assistance "focused on developing the institutions of liberty, the rule of law and property rights."

Obama, in a speech later in the morning to the U.N. General Assembly, said the recent assaults on U.S. citizens in Libya "were attacks on America" and called on world leaders to join in confronting the root causes of the rage across the Muslim world.

But in a slap at Romney, Obama said "let us remember that this is a season of progress" in the Arab World, where autocratic leaders have been deposed in several countries.

In another jab, he said, "Among Israelis and Palestinians, the future must not belong to those who turn their backs on peace."

Obama didn't mention it, but Romney says on a videotape that recently came to light that "the Palestinians have no interest whatsoever in establishing peace. The pathway to peace is almost unthinkable to accomplish."

BBC apologises to Queen Elizabeth over radical cleric leak

LONDON (Reuters) - Britain's BBC apologised to Queen Elizabeth on Tuesday after a senior journalist reported her private views about one of the country's best known terrorism suspects, an embarrassing disclosure for a monarch who avoids public political statements.

BBC security correspondent Frank Gardner broadcast details of a private conversation with the queen during which she supposedly told him she had complained to the last government about radical Muslim cleric Abu Hamza al-Masri.

The queen was said to be upset that Britain had not arrested him after he preached fiery anti-Western sermons outside a mosque in London after the September 11, 2001 attacks in the United States.

That was awkward for a head of state who has no political or executive role and is expected to stay neutral in public. The queen has never given a media interview and typically avoids controversial topics in her speeches.

The Egyptian-born cleric lost an appeal in the European courts on Monday and faces extradition from the country to the United States. Washington accuses him of supporting al Qaeda, aiding a kidnapping in Yemen and plotting to open a U.S. training camp for militants.

Delays in arresting the cleric angered many in the country. Newspapers campaigned for his extradition, with the Sun using the headline "Sling Your Hook", a reference to the metal hook he wore in place of a hand he lost in disputed circumstances.

The public broadcaster, mainly funded by a fee paid by everyone under 75 who owns a television, said the meeting had taken place some years ago.

"The conversation should have remained private and the BBC and Frank deeply regret this breach of confidence. It was wholly inappropriate," the BBC said. Buckingham Palace had no comment.

A former banker, Gardner has worked for the BBC since 1997. He was partly paralysed in 2004 after being shot on assignment in Saudi Arabia.

Elizabeth holds a weekly private audience with the prime minister to discuss topical issues. There have been 12 prime ministers since her coronation in 1953, from Winston Churchill to David Cameron.

Republic, a group that campaigns for the monarchy's abolition, accused the royal family of a "cynical PR ploy" designed to win popular support.

"The decision to disclose this one conversation while keeping all else secret smacks of a deliberate PR stunt to put the queen on the right side of public opinion," the group's head Graham Smith said.

After well-received celebrations to mark the queen's 60 years on the throne this summer, the royal family has suffered two embarrassing episodes in recent weeks.

Naked pictures of Elizabeth's grandson Prince Harry at a Las Vegas hotel were published around the world, swiftly followed by topless photos of Catherine, Duchess of Cambridge -- the former Kate Middleton who is the wife of Harry's brother William, second in line to the throne.

Cancer Council NSW has just launched?Brain Cancer Action Week, spearheaded by neurosurgeon Charlie Teo.See Dr.Teo here.

I certainly support the Cancer Council in its initiative but an very concerned that in its press release any mention of mobile phone use as a risk factor is totally avoided. Then we have CEO Andrew Penman actually stating in part: ?Risk factors of brain cancer are unknown?. Really???

Also on the Cancer Council NSW?s website it lists the following under ways to ?Reduce Risks?

1) Sun Protection
2) Eating and moving
3) Smoking
4) Screening
5) Local Governemnt: promoting healthy local living
6) Cancer in the workplace
7) Alcohol
8) Healthy eating after cancer


Is this another Harry Potter/Lord Voldemort moment where that-which-must-never-be-named comes into play? I find it surprising that Cancer Council NSW can use respected neurosurgeon Charlie Teo to promote its funding drive but still downplay the issue of mobile phone use and the increased risk of brain cancer. If you dig down into the council?s web site you can find the topic mentioned but in a dismissive way. For example there is CEO Andrew Penmen?s factually incorrect statement?Brain cancer mobile phone panic should be put on hold?I highly recommend reading this statement which reads more like something?AMTA?has spewed out.

Is Penman saying here that until conclusive evidence is obtained, precautionary advice should not be given? Does this reluctance extend to not advising recovering brain tumour patients to avoid using their mobile phones? Unfortunately I think yes.

Brain cancer is the leading cause of cancer death in young people* and accounts for more than one third of cancer deaths in children aged under 10.

This alarming statistic marks the commencement of the second annual?Brain Cancer Action Week, an initiative designed to raise awareness and funds for research into brain cancer, the least funded and deadliest cancer in Australia.

Today, leading neurosurgeon,?Dr Charlie Teo, joined Cancer Council in launching the week by calling for an increase in funding for research into brain cancer.

Dr Teo said, ?People continue to believe that cancer is a disease that strikes as you get older. I saw 23 patients last week. Twenty were diagnosed with malignant brain cancer. Eight of those diagnosed were under 16 years old.

?It will take $50 billion over the next 30 to 50 years to find a cure for brain cancer but we need some significant funds injected now if we are to see any reduction in brain cancer related deaths."

?Once diagnosed, patients have just a five per cent chance of surviving this extremely aggressive disease. Most die within six months."

Dr Andrew Penman, CEO of Cancer Council NSW echoed Dr Teo?s call for funding.
Dr Penman said, ?Despite having a fatality rate of almost 100 per cent, brain cancer remains the least understood of all the cancers. It?s the biggest cancer killer of young people and we need funds to change this.

?Each year about 1400 cases of malignant brain cancer are diagnosed in Australia and about 1100 people die from the disease. That?s one every eight hours. Risk factors of brain cancer are unknown and there are no screening procedures in place. Until we have the funds for more research, the survival rate will not improve."

?A third of cancers can be prevented by making conscious lifestyle choices, for example by not smoking, eating a balanced diet and exercising regularly. However, brain cancer is indiscriminate and due to the lack of research we don?t know how to prevent it."

?Worryingly, there has been no significant improvement to brain cancer survival rates in almost two decades, but with research we can make a difference. Look at leukaemia, which killed 90 per cent of patients just 15 years ago. The figure has now turned on its head with a survival rate of 90 per cent due to funds for research. Brain Cancer Action Week aims to be instrumental in offering brain cancer patients a similar turn around in survival rates.?

Brain cancer mobile phone panic should be put on hold
Australians should not unnecessarily panic about mobile phones causing brain cancer according to Cancer Council NSW CEO Dr Andrew Penman. Dr Penman said that numerous studies around the world have failed to prove that mobile phones are a cause of brain cancer. ?Mobile phones have been widely used in Australia for nearly 20 years now. Contrary to concerns about mobile phones, we have seen absolutely no associated increase in brain cancer cases in Australia or overseas,? Dr Penman said. ?Users should therefore not unduly worry that their device will give them brain cancer. ?More research is desperately needed to find out what actually does cause brain cancer and how treatments can be improved. ?Currently, brain cancer is the number one cancer killer of children and has a survival rate of just 5 per cent in its most aggressive form. Yet, it?s the most under-studied cancer with little research funding.?

Cancer Council NSW has funded more than $4.8 million worth of research grants in brain cancer during 2011 and more than $8.6 million in the last five years.
